By accessing or using Zavara Studio ("the Service"), operated by Zavara Studio Inc. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.
One person or legal entity may maintain no more than one free account. You are responsible for all activity that occurs under your account.
Paid plans are billed in advance on a monthly basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period. If you cancel, your account reverts to the Free plan at the end of the paid period.
We reserve the right to change pricing with 30 days' written notice. Price changes do not apply to the current billing period.
"User Content" means any files, images, text, sketches, or other materials you upload or create through the Service. You retain all ownership rights to your User Content.
By uploading User Content, you grant us a limited, non-exclusive license to store, process, and display it solely for the purpose of providing the Service to you and your clients.
You are responsible for ensuring you have the right to upload and share any content. We may remove content that violates these terms or applicable laws.
The Service includes AI design and photography features that generate images based on your inputs. AI-generated content is provided "as is" and may not always produce accurate, complete, or suitable results.
You may use AI-generated images for your business purposes, including sharing with clients. We do not claim ownership of AI-generated content created through your account.
AI generation usage is subject to your plan's monthly limits. We reserve the right to modify AI features, models, and limits at any time.
When you share a project with a client via the portal, you are responsible for the content shared and for informing your clients about how their data is used.
Client portal access is provided through unique, tokenised links. You are responsible for sharing these links securely and only with intended recipients.
Payment collection between jewellers and their clients is facilitated through Stripe. We are not a party to the transaction between you and your client. You are responsible for all tax obligations arising from payments received through the Service.
The Service, including its design, code, and branding, is owned by Zavara Studio Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities.
Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
You may close your account at any time. We may suspend or terminate your account if you violate these terms, engage in abusive behaviour, or fail to pay applicable fees.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or legitimate business purposes, subject to our Privacy Policy.
These terms are governed by the laws of the jurisdiction in which Zavara Studio Inc. is incorporated, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction.
